Responding to complaints

An allegation of professional misconduct can tarnish your reputation and place your law license in jeopardy. If you receive notice that a grievance has been filed against you, it is critical that you take immediate action by consulting with an attorney experienced in grievance defense. You may be tempted to respond on your own, but individuals who represent themselves during this initial investigation may be treated very differently than those who have retained experienced legal counsel.

Investigatory hearings are touted as "non-adversarial" in nature, but the hearing is set only if the CDC is unwilling to make a recommendation of dismissal.  While some cases may be dismissed after the hearing, this process is used by the CDC to coerce an agreed sanction and/or as a precursor to formal discovery.  


Evidentiary hearings are often selected in lieu of a district court tiral without a full appreciation of the process.  For example, the confidentiality provisions cannot be enforced against the complainant; and rules of procedure and evidence that safeguard the integrity of the judicial process are not strictly followed.
